These Terms of Service ("Terms") govern your access to and use of the websites, products, and services provided by Digital Views Media LLC ("Digital Views Media", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Services

Digital Views Media provides web design and development, AI chatbot and voice agents, SMS automation, marketing automation, SEO, and related consulting services to businesses. The specific scope, deliverables, timelines, and fees for any engagement will be set out in a separate agreement, proposal, or statement of work.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use our services.

3. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws;
• Attempt to interfere with, compromise, or disrupt our systems or security;
• Use our services to send spam, unsolicited messages, or harmful content;
• Reverse engineer, copy, or resell our proprietary software without permission;
• Impersonate any person or entity or misrepresent your affiliation.

4. SMS Communications

If you provide your phone number to us or to a business that uses our services, you consent to receive SMS messages as described in our Privacy Policy. You may opt out at any time by replying STOP to any message. Message and data rates may apply. Message frequency varies.

5. Fees & Payment

Fees for services are described in the applicable proposal or agreement. Unless otherwise stated, all fees are non-refundable and must be paid when invoiced. Late payments may result in suspension of services.

6. Intellectual Property

All content, software, and materials owned, developed, or licensed by Digital Views Media remain our property. Upon full payment for a specific engagement, ownership of deliverables custom-built for you transfers as described in the applicable agreement, except for any pre-existing or third-party components.

7. Third-Party Services

Our services may integrate with third-party tools (e.g., Telnyx, Twilio, Vercel, Supabase, Stripe, Google). We are not responsible for the availability, accuracy, or practices of third-party services.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Digital Views Media's total liability arising out of or in connection with these Terms or your use of our services shall not exceed the fees paid by you to us in the three (3) months preceding the claim. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages.

10. Indemnification

You agree to indemnify and hold harmless Digital Views Media from any claims, damages, or expenses arising out of your use of our services, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to our services at any time for any reason, including breach of these Terms. Sections of these Terms that by their nature should survive termination will do so.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Digital Views Media LLC is registered, without regard to its conflict of laws principles.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.
